1. About these terms
These terms apply to the website performance-elite-conditioning.com and to the PEC mobile app, provided by FOOTBALL4PRO d.o.o. za usluge, Dubrava 120, 10000 Zagreb, Croatia, OIB 12559092859 (“PEC”, “we”). By using the website or the app you accept these terms. The services we provide to players and clubs (diagnostics, programmes, camps) are governed by separate contracts; if a contract and these terms differ, the contract prevails.
How we handle personal data is explained in our Privacy Policy.
2. Website
The website presents PEC and our services. Its content is for general information only and is not medical advice or a personalised training programme. Before starting any training, consult a qualified professional.
We make every effort to keep the information accurate and up to date, but we do not guarantee that the website is complete, error-free or always available, and we may change or remove content at any time. Links to other websites are provided for convenience; we are not responsible for their content.
3. Intellectual property
The PEC name and logo, texts, photos, videos, design and the app are owned by us or used with permission and are protected by copyright and trademark law. You may view and share links to the website for personal, non-commercial purposes; any other copying, modification or distribution requires our prior written consent.
Club names and crests shown on the website belong to their respective owners and are used only to indicate players and clubs we have worked with. Their display does not imply endorsement. Photos of players are published with their consent.
4. PEC app — access
The PEC app is free to download but can be used only by players and clients who have a contract with PEC. Accounts are created by PEC; access ends when the contract ends or if these terms are breached. Keep your login details confidential and let us know immediately if you believe someone else has used your account. You are responsible for activity under your account.
You may use the app only for your own training with PEC. You may not copy, share, sell or publish training programmes, videos or other content from the app, attempt to access other users' data, or interfere with the app's operation or security.
5. Training and health
Programmes in the app are prepared for you by PEC coaches based on the information you provide. Follow the instructions, warm up properly and train within your limits. Stop training and contact your coach or a doctor if you feel pain, dizziness or any other unusual symptoms. Keep your coach informed about injuries, illness and changes in your health. The app does not replace medical examination or treatment.
6. Your device and connection
The app needs an internet connection for some functions. We are not responsible if the app does not work fully because you have no connection or your data allowance is used up. Your mobile operator may charge for data, including roaming abroad; these costs are your responsibility.
Keep your device and the app secure and up to date. Do not jailbreak or root the device you use for the app: this removes the operating system's protections, may expose your data and may stop the app from working properly.
The app is distributed through the App Store and Google Play, whose terms also apply to the download. Apple and Google are not responsible for the app or its content.
7. Updates and availability
We may update the app, change its features or stop supporting older versions or operating systems. You must install updates to continue using the app. We may also temporarily suspend the app for maintenance, or discontinue it, in which case we will inform users in good time; your rights under the contract with PEC remain unaffected.
8. Liability
We provide the website and the app with due care. To the extent permitted by law, we are not liable for indirect damage, for damage caused by improper use or by ignoring instructions, or for interruptions outside our control. This does not limit liability for intent or gross negligence, for injury to life, body or health caused by our fault, or any rights you have as a consumer that cannot be excluded by law.
9. Changes to these terms
We may change these terms. The current version is always published on this page with the date of the last update; we will notify app users of significant changes in the app or by e-mail. Continuing to use the website or the app after a change means you accept the new terms.
10. Governing law and contact
These terms are governed by the laws of the Republic of Croatia. Disputes will be resolved by the competent court in Zagreb, without prejudice to mandatory consumer protection rules of the country where you live.
